Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of CertVault's Terms of Service. It sets out what you may and may not do when using the CertVault platform. Violations may result in account suspension or termination.

1. Who This Policy Applies To

This AUP applies to all users of the CertVault platform, including Workers, Employers, and any other person who accesses or uses the platform in any capacity.

2. Prohibited Conduct โ€” All Users

Regardless of your account type, you must not:

2.1 Fraud and Misrepresentation

  • Upload, submit, or share documents that are forged, altered, expired, revoked, or otherwise fraudulent.
  • Impersonate any person, company, or authority.
  • Create multiple accounts to circumvent a suspension or restriction.
  • Misrepresent your identity, qualifications, or relationship to any employer or worker.

2.2 Harmful Content

  • Upload files containing malware, viruses, ransomware, spyware, or any other malicious code.
  • Upload content that is unlawful, defamatory, obscene, threatening, or otherwise harmful.
  • Upload content that infringes the intellectual property rights of any third party.

2.3 Platform Integrity

  • Attempt to gain unauthorised access to any account, system, or data on the platform.
  • Use automated bots, scrapers, or crawlers to collect data from the platform without our prior written consent.
  • Interfere with or disrupt the platform's infrastructure, servers, or networks.
  • Circumvent or attempt to circumvent any security or access control measures.
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the platform.

2.4 Privacy and Harassment

  • Collect, harvest, or store personal information about other users without their consent.
  • Use the platform to harass, stalk, threaten, or harm any person.
  • Share any other user's personal information outside the platform without their consent.

3. Prohibited Conduct โ€” Workers

As a Worker, you must not:

  • Upload documents belonging to another person, or upload on behalf of another person without their explicit written consent.
  • Allow another person to use your account to present their documents as if they were yours.
  • Upload documents that you know to be expired, cancelled, suspended, or revoked.
  • Represent that a document has been independently verified by CertVault (it has not โ€” see our Disclaimer).

4. Prohibited Conduct โ€” Employers

As an Employer, you must not:

  • Access Worker profiles or documents for any purpose other than evaluating workers for genuine employment or engagement.
  • Download, copy, or redistribute Worker documents beyond what is reasonably necessary for that evaluation.
  • Use Worker information to make unlawful employment decisions based on protected attributes (age, gender, race, disability, religion, etc.) under the Fair Work Act 2009 (Cth) or state equivalents.
  • Share Worker personal information with third parties without the Worker's consent and a lawful basis under the Privacy Act 1988 (Cth).
  • Contact workers outside the platform in a way that is harassing, unsolicited, or in breach of the Spam Act 2003 (Cth).
  • Represent to a Worker that CertVault has endorsed, verified, or approved the Worker for a role.

5. Consequences of Violations

We reserve the right to take the following actions in response to violations of this AUP, at our sole discretion:

  • Issue a warning.
  • Remove offending content.
  • Suspend your account temporarily.
  • Terminate your account permanently without refund.
  • Refer the matter to law enforcement or relevant regulatory authorities.
  • Seek damages or other legal remedies.

We may act without prior notice where we reasonably believe the violation poses an immediate risk to users, third parties, or platform integrity.

6. Reporting Violations

If you become aware of any content or conduct that violates this AUP, please report it to us at legal@certvaultapp.com. We take all reports seriously and will investigate promptly.

7. Changes to This Policy

We may update this AUP from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated AUP.
